The Terms and Conditions set out below, (hereinafter the "TC"), govern the online retail shop service for the articles offered by La Marquesa Style, (hereinafter the "Articles" or, individually, the "Article"), accessible from the website "www.lamarquesastyle.es".

The Terms and Conditions are made up of the following sections:

If you are interested in purchasing one of the Articles through the service of the online shop you will acquire the status of customer, (hereinafter, the "Customer"), so please read the following conditions carefully before starting the purchase process.

1.- IDENTIFICATION AND CONTACT DETAILS OF THE SERVICE PROVIDER.

The TC regulate the sale of the products of the website "www.lamarquesastyle.es" or online shop presented by the commercial entity, "NOELIA SÁNCHEZ PICAZO", whose identification data are the following:

2.- GENERAL CONDITIONS OF PURCHASE AND THEIR ACCEPTANCE.

The online shop service of La Marquesa Style is subject to the present TC, which are complemented by the general conditions of access and use of the website "www.lamarquesastyle.es", which the Client must consult through the "Legal Notice" of the aforementioned portal prior to accessing the online shop and which will be inexorably linked to the present TC with their acceptance by the Client.

In the event that the aforementioned general conditions of access and use of the website "www.lamarquesastyle.es" contain clauses that contradict these TC, the latter shall take precedence over the former.

As a Client, you declare that you are of legal age and have sufficient legal capacity to be bound by these TC when contracting with La Marquesa Style.To make a purchase through the online shop La Marquesa Style will require the Customer to register or have previously registered and accept these TC. Also, the Customer must re-accept the TC at the end of the purchase process in the version published by La Marquesa Style at the time of carrying out the last transaction.

Consequently, La Marquesa Style reserves the right to modify the commercial offer presented on the website and its TC, (modifications on products, prices, costs, promotions and other commercial conditions), being applicable to the purchase made by the Customer those TC that had accepted at the end of the purchase process.

3.- COVERAGE OF THE ONLINE SHOP.

The online shop service is intended for end consumers, in the sense established by Royal Legislative Decree 1/2007, of 16 November, of the Law on Consumers and Users. Therefore, wholesalers, distributors, purchasing centres, department stores and other intermediaries in the footwear sector are excluded from the service.

By virtue of the foregoing, the resale of the Articles purchased through the online shop is strictly prohibited.

The Articles offered through the La Marquesa Style online shop are distributed in Spain.

4.- THE ARTICLES AND INFORMATION PROVIDED ON THE WEBSITE.

All the Articles offered on this website are a selection of products from the women's collection of the brands.

Each Article is accompanied by the following information: Name of the Article, images of the Article, description of the Article, collection to which the Article belongs, available sizes, price (taxes included) and shipping costs.

La Marquesa Style makes every effort within its means to offer the information contained on the website truthfully and without typographical errors, as well as to show the colours of the Articles as true to reality as possible. However, the colour of the Articles displayed on screen may be subject to variations depending on the quality of the Customer's computer monitor.

However, if the written information provided through the website does not correspond to the reality of the Article, the Customer shall have the right to cancel the purchase without any cost on his part.

5.- PURCHASE PROCEDURE AND REGISTRATION.

A) REGISTRATION: To make a purchase through the online shop of La Marquesa Style is not necessary for the Customer to register beforehand and open a customer account. If desired, the Customer must complete the registration form which can be accessed by clicking on the links called "My Account" and "Create one". Once the Customer has registered, their details will be saved for future purchases.

B) CHOICE: Subsequently, the Customer must select the desired Article by clicking on its image, and then see the image, description and sizes available.

Once the Customer has chosen the desired Article, he/she must select the size and click on the link "Add to my basket".

C) MY CART: Once the selection has been completed, the customer can continue with the purchase process or select a new product by clicking on it.

Once the Customer has selected all the Articles that he/she wishes to purchase, he/she must check that the details of the Articles that appear in the basket are correct (photo, model, number, pairs).

Likewise, the basket will show the price of each Article (taxes included) and the total price of the purchase.

The order must be confirmed by clicking "Finalise purchase" and then choose the method of payment.

D) METHOD OF PAYMENT: The Customer must select the desired method of payment.

For payments by credit or debit card (Visa and Mastercard), the payment will be charged in real time via the Shopify Payments payment gateway, once the authenticity of the data provided has been verified.

The payment gateway system used offers maximum security and the payment details are transmitted directly and encrypted (SSL) to the corresponding financial institution.

E) CONFIRM: Once the payment method has been selected, and before sending the order, the Customer will be able to view a summary of the delivery details, the payment method and the order.

The order must be confirmed by clicking on the "Pay now" link.

Confirmation of receipt of the order will be communicated via the website, indicating the order number so that the Customer can track the order via the link "My orders" located within their user account.

Likewise, an e-mail message will be sent with a description of the order.

La Marquesa Style does not ship to PO boxes.

6.- CURRENCY AND APPLICABLE TAXES.
The prices of the online shop of La Marquesa Style are shown in euros.

The website will provide the Customer with all the information about the price and characteristics of the Articles before finalizing the purchase process.

Prices in euros are inclusive of 21 percent VAT.

7.- SHIPPING COSTS AND DELIVERY TIMES.

The shipping costs of the Articles purchased through the online shop shall be borne by the Customer. The amount is as follows:

Shipments to Spain (Peninsular) - Correos:

• Shipments between 0kg - 1 kg: 4,20€ (VAT included)

Shipments to Spain (Peninsular) - Correos Express:

• Shipments between 0kg - 1 kg: 4,80€ (VAT included)

After confirmation that the payment has been processed, the estimated time for shipments to mainland Spain is as follows:

• 24h (1 business day) with Correos Express
• 48h or 72h (2 to 3 working days) with Correos.

Orders will be shipped during working hours. Therefore, to avoid incidents in the delivery, the Customer must indicate the address where the order can be delivered during these hours, as well as a contact telephone number.

La Marquesa Style does not deliver to PO Boxes or CityPaqs.

If for reasons of force majeure the order cannot be delivered, the total amount of the purchase will be refunded.

La Marquesa Style online shop is not responsible for delays in cases of force majeure, such as interruption of activity or total or partial strike of postal services and means of transport or communications, flood or fire.

8.- RETURNS OR EXCHANGES OF PURCHASED ITEMS.

Items purchased from La Marquesa Style can be returned within 14 days of receipt of delivery in most cases. During this period, you can try on the product and inspect it as if you were buying something in a physical shop. The product must be in the same condition in which you received it and without any damage. You can remove the product from its packaging, unless it is sealed.

Returns will not be accepted if it is perceived that the garment has been worn.

If you decide to return the items, you will need to let us know by filling in the return form on our website, or by using the withdrawal form below. You can also let us know that you want to return your order by sending an email to noelia@lamarquesastyle.es. Please note that you must send the items back to us within 14 days of informing us.

Processing your Return

After we receive your return shipment, we will inspect the returned items and begin processing your refund. The money will be refunded to the original payment method you used during purchase, unless you prefer otherwise. The refund will be paid within 7 days. You will have to cover the return shipping costs yourself. The costs will be an estimated maximum of 4.

Items that cannot be returned

The following types of items cannot be returned:

Products that have been custom-made to the buyer's specifications such as: Products that have been custom-made.

9.- GUARANTEE
The product warranty in case of defect is 2 years from the date of delivery. The USER must report the lack of conformity within 2 months of becoming aware of it.

10.- SECURITY POLICY.
For the purposes of Law 15/1999, of December 13, Protection of Personal Data, (hereinafter, the LOPD) informs the Customer that the data obtained as a result of the purchase process will be incorporated into a file duly registered in the General Register of Data Protection, which is responsible and recipient is La Marquesa Style" by this: Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, and the rights to which the Client may revoke their consent are: access, rectification, deletion, limitation of processing or portability of the data.

11.- COOKIES AND LINKS.
The User is informed that the WEBSITE uses cookies for the sole purpose of storing certain USER data so as not to require them constantly. These cookies or small data files that the browser stores on the hard disk of the USER's computer are temporary and are deleted from the computer when the browser session is closed and/or, in any case, expire after 30 minutes. 3 types of cookies are used:
